These Terms and Conditions ("Terms") are a binding agreement between you ("User," "you") and TRICKS INC, operating as Moden ("Moden," "we," "us," or "our").

By accessing or using any part of the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. The Services

These Terms govern your use of all Moden products and services (collectively, the "Services"), including:

  • The Moden component library and its documentation and included resources;
  • The Moden website and any web-based tools we make available;
  • The Moden Webflow App, a Designer Extension that runs inside the Webflow Designer and provides tools for editing styles, optimizing images, and auditing Webflow projects.

2. Access and Subscription

A single Moden subscription grants you access to all of the Services for the duration of your active subscription period.

  • Moden offers a monthly plan.
  • Subscriptions renew automatically unless canceled before the renewal date.
  • Upon cancellation, you retain access until the end of your current billing cycle. After that, your access to the Moden website, to new and existing components, and to the Moden Webflow App will end.
  • An active subscription is required to use the Moden Webflow App. The App verifies your subscription status when you sign in.
  • Your account is for your individual use. Accounts may not be shared across multiple people or organizations.

3. License and Usage

3.1 Components and Resources

  • You may use Moden components in unlimited personal and commercial projects, including client work.
  • You may not resell, redistribute, or include Moden components in any product or service that competes with Moden — including template libraries, design systems, or similar component collections.
  • You may not share, transfer, or sublicense your Moden account to others.
  • Components are provided as-is, without guarantee that they will function identically across all environments or across updates to Webflow.

3.2 The Moden Webflow App

Subject to your active subscription and compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Moden Webflow App on Webflow projects you own or are authorized to work on, including client projects.

You may not:

  • Copy, redistribute, sublicense, rent, lease, or resell the App or any part of it;
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent this restriction is prohibited by applicable law;
  • Circumvent, disable, or tamper with any authentication, licensing, or subscription-verification mechanism;
  • Use the App to develop, or assist in developing, a product or service that competes with Moden.

4. Your Webflow Projects and Content

The Moden Webflow App modifies the Webflow project you have open. Depending on the tool used, this may include creating or changing styles and classes, editing custom code embeds, and replacing or optimizing image assets.

You are solely responsible for:

  • Ensuring you have the necessary rights and authorization to modify any project you use the App on, including client projects;
  • Maintaining your own backups, version history, or site backups before making changes;
  • Reviewing all changes made through the App before publishing them.

Changes made by the App may be permanent and may not be fully reversible through Webflow's undo history or backups. You should treat the App as you would any tool that edits production work.

You retain all right, title, and ownership in your Webflow projects, your content, and any output produced using the Services. We claim no ownership over your sites, designs, images, or code.

5. Acceptable Use

You agree not to:

  • Use the Services in violation of any applicable law or regulation;
  • Use the Services on any project you do not own or have permission to modify;
  • Use automated means to access, scrape, or interact with the Services in a manner that places unreasonable load on our infrastructure;
  • Use the Services to infringe the intellectual property or other rights of any third party.

6. Third-Party Platforms and Non-Affiliation

The Moden Webflow App operates inside Webflow and depends on Webflow's Designer API. That platform and its APIs may change, break, be restricted, or be discontinued at any time, entirely outside our control. We do not guarantee continued compatibility with Webflow.

Your use of Webflow is governed by Webflow's own terms and policies. Your use of our payment, authentication, and infrastructure providers is likewise governed by their respective terms.

Moden is an independent product and is not affiliated with, endorsed by, sponsored by, or otherwise associated with Webflow, Inc. "Webflow" is a trademark of Webflow, Inc.

7. Modifications to the Services

We may add, modify, improve, or remove tools, features, components, or functionality within the Services at any time. We may also discontinue the Moden Webflow App or any individual tool, with reasonable notice where practicable.

The Services are actively developed, and specific tools available today may not remain available indefinitely. Your subscription grants access to the Services as they exist during your subscription period, not to any particular feature or tool.

8. Refund Policy

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

9. Support

Moden does not include one-on-one technical support.

  • Components include documentation, read-only project links, and a ready-to-copy structure designed to make implementation straightforward.
  • The Webflow App includes in-product documentation where applicable. We welcome bug reports, but we do not guarantee a response time, a fix, or support for any individual project, configuration, or use case.

10. Intellectual Property

All components, documentation, website content, and the Moden Webflow App — including its software, source code, interface, and design — are the intellectual property of TRICKS INC. You are granted a limited, non-exclusive, non-transferable license to use these materials in accordance with these Terms.

Any unauthorized reproduction, redistribution, or resale of Moden content or software is strictly prohibited.

This section does not affect your ownership of your own projects and content as described in Section 4.

11. Privacy

Your use of the Services is also governed by our Privacy Policy, which describes what information is processed and how. Notably, design and image data processed by the Moden Webflow App is handled locally in your browser and is not transmitted to us.

12. Termination

We reserve the right to suspend or terminate your access to the Services at any time if we determine that your account has violated these Terms, or has engaged in misuse, redistribution, or reselling of components or software.

You may cancel your subscription at any time; cancellation takes effect as described in Section 2.

Sections 4, 10, 13, 14, 15, and 16 survive any termination of these Terms.

13. Disclaimer of Warranties

The Services are provided "as-is" and "as available" without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Services will be error-free, uninterrupted, secure, or compatible with any particular version of Webflow, browser, or project configuration, or that any defect will be corrected.

14. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall TRICKS INC, its officers, employees, or affiliates be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising out of or relating to your use of or inability to use the Services — including any loss of data, content, work product, or damage to any Webflow project or website — even if advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to the Services shall not exceed the total amount you paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless TRICKS INC from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Services, your violation of these Terms, or your modification of any project you were not authorized to modify.

16. Governing Law

These Terms are governed by the laws of Louisiana, United States Of America, without regard to its conflict-of-law provisions.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Changes to Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated "Last updated" date. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
